Shoultz, Townsend to Address Wind Energy Development in Indiana

The law firm of Bose McKinney & Evans LLP is pleased to announce that attorneys Nikki Shoultz and Alan Townsend will speak at the Indiana Continuing Legal Education Forum’s seminar focusing on the development of wind energy in Indiana.

The program, THE WINDS OF CHANGE: Wind Leases in Indiana will take place from 9 a.m. to 12:15 p.m. on Nov. 10 at the ICLEF Conference Facility, 230 East Ohio Street—5th Floor, Indianapolis, IN 46204. Shoultz will address issues of particular interest to landowners who are approached by wind farmers interested in developing their land, while Townsend will focus on wind farm litigation issues. Specific topics to be addressed include property acquisition, landowner contract concerns; county ordinances; compensation models, and regulatory approvals.

Nikki Shoultz is a partner in the Utility Group and a member of the Renewable Energy Group and represents clients with energy, telecommunications, technology, e-commerce, wind, water and sewer matters. Ms. Shoultz has assisted landowners, developers, municipalities and utilities with wind leases, power supply agreements, easements, zoning and service territory disputes, water and sewer capacity issues, contract disputes, main extension agreements, annexation and real estate transactions.

A partner at Bose McKinney & Evans and the vice chair of the Litigation Group, Townsend focuses his practice on business litigation issues including land-use disputes. He has been recognized by The Best Lawyers in America for his work in condemnation and eminent domain proceedings on behalf of cities, towns, schools and utilities.

Bose McKinney & Evans Elects Gaither as New Firm Managing Partner

The law firm of Bose McKinney & Evans LLP is pleased to announce that Jeffrey R. Gaither has been elected the firm’s new managing partner.

Gaither is a partner in Bose McKinney & Evans’ Litigation Group, representing clients in complex commercial litigation, appeals and arbitrations. He has represented clients in a variety of liability matters, including trade secrets, business torts, unfair competition, corporate contracts, securities litigation, fraud and RICO matters, false advertising, franchise and distributor matters, and minority shareholder and fiduciary duty claims.

Gaither received his J.D., cum laude, from the Indiana University School of Law-Indianapolis and his Bachelor of Science in public affairs from Indiana University. He is a frequent speaker on business litigation and related topics. He is admitted to practice law in Indiana, the U.S. District Court, Southern and Northern Districts of Indiana, the U.S. Court of Appeals for the Sixth and Seventh Circuits, and the U.S. District Court for the Eastern District of Michigan.

Moloy is a partner in Bose McKinney & Evans’ Bankruptcy and Creditors’ Rights Group. He has experience representing creditors and debtors in loan workouts and bankruptcy cases. Moloy has participated in complex Chapter 11 cases involving electric utilities, motorsports, transportation and logistics, automotive manufacturing and steel manufacturing.

Bose McKinney & Evans Attorneys Present Intellectual Property Seminar

The law firm of Bose McKinney & Evans LLP is pleased to announce that partners James A. Coles and Anthony P. Filomena will be featured presenters at an upcoming Intellectual Property Seminar on Monday, February 1, 2010 from 2:30-4:30 p.m.

The free seminar, Software Patent: Oxymoron or Sound Business Practice? A Guide for Assessing Whether Patent Protection is Worthwhile, will be held at Indiana University Innovation Center, Conference Room 105, 2719 East 10th Street in Bloomington, Ind. Registration will begin at 2:00 p.m.

The attorneys will present the criteria that will help determine what software is patent eligible and whether patent protection is worthwhile. They also will discuss copyright protection as an alternative to patents, including the advantages and disadvantages of each. Finally, the speakers will provide a brief history of software patent eligibility over the years to help illustrate the current state of patent confusion and will address the impact of the Bilski decision of 2008.

Bose McKinney & Evans Welcomes Musser as New Associate

The law firm of Bose McKinney & Evans LLP is pleased to announce that Paul Musser has joined the firm as an associate in the Bankruptcy and Creditors’ Rights Group and the Litigation Group.

He assists borrower and creditor clients in connection with collections, bankruptcy and foreclosure issues and proceedings. Prior to joining Bose McKinney & Evans, Musser served as a judicial intern for The Honorable David Hamilton in the U.S. District Court for the Southern District of Indiana. He was also an intern for the Neighborhood Christian Legal Clinic assisting asylum applicants, a research assistant at Indiana University School of Law and a summer associate with Bose McKinney & Evans in 2008.

Stucky Participates in Greening of the Indiana Memorial Union

The law firm of Bose McKinney & Evans LLP is pleased to announce that partner Natalie J. Stucky is participating in the Greening of the Indiana Memorial Union on Indiana University’s Bloomington campus.

The Greening eco-charrette will take place on Dec. 2-3 to look for ways to make the iconic structure more energy, water and resource effective while retaining its historic charm.

Patterned after other famous eco-charrettes, such as the Greening of the White House, the Greening of the Pentagon and the more recent Greening of the City County Building in Indianapolis, this charrette will be facilitated by national and local experts in collaboration with IMU and IU administration and staff. Because of its location and purpose, it will also include student participation. 

The Greening of the IMU will be facilitated by Hellmuth+Bicknese LLC with the Leonardo Academy. Both firms helped write the LEED rating system. Sponsored by a grant from the Duke Energy Foundation, this charrette will explore cost-effective ways for the IMU to green its operations and maintenance processes using LEED for Existing Buildings Operations and Maintenance as a framework.

Calderon Re-Elected as Chair for Hamilton County Advisory Board of United Way of Central Indiana
